Fair Use Policy (Strict Legal Version)
Last updated: [insert date]
1. Purpose and Scope
This Fair Use Policy (“FUP”) applies to all services described or advertised as “Unlimited.” While the Company provides these services without predefined limits, the term “Unlimited” refers to usage within reasonable and lawful parameters, consistent with the typical use expected from the average customer. The Company retains absolute discretion to determine what constitutes “fair” or “unreasonable” use.
2. Company’s Discretion and Authority
The Company reserves the unrestricted right, at its sole and absolute discretion, to:
Monitor, evaluate, and interpret user activity and resource consumption;
Determine whether a user’s activity is consistent with fair and legitimate use;
Impose restrictions, suspensions, throttling, or termination of service without prior notice if usage is deemed excessive, abusive, or detrimental to the system or other users;
Request that a user migrate to a higher or dedicated plan, including Enterprise-grade services, as a condition of continued service.
Decisions made by the Company in relation to fair use shall be final and binding.
3. Acceptable Use
“Unlimited” plans are intended for standard personal or business use, including but not limited to:
File storage and retrieval for personal or internal business purposes;
Data backup and synchronization at reasonable frequencies;
Content management and collaboration within a closed group of authorized users.
4. Unacceptable or Excessive Use
Without limitation, the following constitute unreasonable or prohibited uses:
Operating public or semi-public file sharing, streaming, or download services;
Hosting data for third parties, reselling or redistributing storage capacity;
Using storage for data warehousing, content delivery networks (CDNs), or mirroring large-scale repositories;
Continuous, automated uploading, downloading, or backup processes that impose persistent or abnormal load;
Mining cryptocurrencies or performing any distributed computing tasks;
Activities that violate laws, infringe on intellectual property, or compromise system stability.
5. Enforcement Measures
The Company may take any of the following actions, at its sole discretion and without prior notice:
Issue a written warning or request to reduce usage.
Temporarily suspend or throttle account access.
Terminate or permanently restrict service.
Require upgrade to an Enterprise or custom plan.
Apply additional fees reflecting the level of resource consumption.
6. Acknowledgment of Limited Resources
Although the service is advertised as “Unlimited,” the underlying infrastructure and network resources are finite. Therefore, unlimited use is conditional upon equitable sharing of resources among all users. The Company is not obligated to provide capacity beyond what it considers commercially and technically reasonable.
7. Limitation of Liability
Under no circumstances shall the Company be held liable for any loss, damage, or inconvenience arising from enforcement of this policy, including suspension, restriction, or termination of service due to excessive use or misinterpretation of “Unlimited” claims.
8. Modifications
The Company reserves the right to modify, amend, or replace this Fair Use Policy at any time. Continued use of the service following such modifications constitutes acceptance of the revised policy.

Unlimited Use Disclaimer:
All services marketed as “Unlimited” are governed by the Company’s Fair Use Policy. The Company retains full discretion to define and enforce limits deemed necessary to maintain system performance, integrity, and fair access. Users acknowledge that the term “Unlimited” does not guarantee unrestricted or infinite resource allocation, and that the Company may restrict or terminate service for usage determined, at its sole discretion, to be excessive or abusive.
